1. Der Zugang zu den Design-Photos (auch: Designfotos) der Bilderdatenbank wird nur persönlich gewährt. Für den Zugang ist ein Benutzername und ein Passwort erforderlich. Dies erhält der Nutzer bei seiner Registrierung auf der Website www.simplynicephoto.de.
Das Passwort darf nur dem Nutzer bekannt sein und Benutzername und Passwort dürfen nicht weiter gegeben werden! Wenn der Verdacht besteht, dass jemand Kenntnis vom Passwort hat, muss es umgehend geändert werden oder der Benutzername muss gesperrt werden (dazu ist eine E-Mail an folgende Adresse zu senden: [email protected]).
2. Die Urheber der dort bereitgestellten Fotos räumen den Nutzern für die Nutzung der Bilder zu missionarischen Zwecken gemäß der Bibel (siehe Punkt 4 für weitere Details) ein nicht exklusives uneingeschränktes Nutzungsrecht an den Bildern ein (auch als "Royality free" bezeichnet). Das bedeutet u.a. folgende Nutzungsrechte:
- von den Fotos dürfen die Nutzer unbegrenzt Kopien anfertigen
- digital: Speichern auf der Festplatte, CD, USB-Stick, ... - analog: Abziehen/Ausdrucken der Fotos in beliebiger Größe und Anzahl
- Bearbeiten der Fotos ohne Einschränkungen (Ausnahme siehe Punkt 3)
- Verwenden/veröffentlichen der Fotos (auch kommerzielle Nutzung)
- Die Urheber verzichten ausdrücklich auf das Recht, bei der Veröffentlichung von Fotos als Urheber genannt zu werden, es ist aber nicht verboten, den Urheber zu nennen. Sollte der Urheber genannt werden, so ist keine bestimmte Form einzuhalten.
3. Wir haben mit größter Sorgfalt darauf geachtet, nur Fotos im Design-Bereich zur Verfügung zu stellen, wo auch bei kommerzieller Nutzung nicht die Rechte Dritter verletzt werden. Um dies zu wahren, gilt folgende Einschränkung für die Bearbeitung von Fotos: Ausschnitte von Fotos, wo Personen als Beiwerk abgebildet sind, dürfen nicht so bearbeitet werden, dass die Person mehr als Beiwerk wird. Ansonsten muss das Einverständnis der abgebildeten Person für die Veröffentlichung eingeholt werden.
4. Die Nutzung zu missionarischen Zwecken gemäß der Bibel bedeutet: Die Nutzung der Fotos dient dem Bau am Reich Gottes bzw. der Verbreitung des Wortes Gottes, so wie es in der Bibel beschrieben steht. Die Fotos dürfen zu diesem Zweck unter anderem von allen Mitgliedern der Deutschen Evangelischen Allianz e.V., von allen Mitgliedern der Weltweiten Evangelischen Allianz (WEA) sowie von allen Mitgliedern der Vereinigung Evangelischer Freikirchen e.V. genutzt werden. Im Zweifelsfall gilt die Nutzung als erlaubt, wenn sie im Sinne der Bibel geschieht. Nicht erlaubt ist die Nutzung für Mitglieder von Sekten (z.B. Zeugen Jehovas), deren Glaubensüberzeugung nicht mit den Überzeugungen der Deutschen Evanglischen Allianz e.V. bzw. der Vereinigung Evangelischer Freikirchen e.V. übereinstimmt. Die Nutzung ist auch Einzelpersonen erlaubt, sofern sie keine Verbindung zu einer Organisation haben, deren Glaubensüberzeugungen nicht mit denen der Deutschen Evangelischen Allianz e.V. bzw. der Vereinigung Evangelischer Freikirchen e.V. übereinstimmt und die Nutzung missionarischen Zwecken im Sinne der Bibel (siehe oben) dient. Die Nutzung der Fotos zur Auferbauung der weltweiten Gemeinde und ihrer einzelnen Glieder ist explizit erlaubt. Ebenfalls explizit erlaubt ist die kommerzielle Verwendung der Fotos für Postkarten/Grußkarten, Kalender u.ä., die das Wort Gottes verbreiten bzw. zur Auferbauung der weltweiten Gemeinde und ihrer einzelnen Glieder dienen.
English Version
1. Access to the Design-Photos (also: "Designfotos") is only granted personally. To access the design photos a username and password is required which you get by registering on the website www.simplynicephoto.de. Only the user is allowed to know his password and it is not allowed to pass on the username and/or password. If you have the suspicion that someone knows your password you have to change it immediately or your username has to be locked (in this case please send an E-Mail to [email protected]).
2. The owners of the provided photos grant the users a non exclusive unlimited right of use (also called "royality free") on these provided design photos for missionary purposes according to the Bible (see point 4 for further details). This contains e.g. the following rights of use:
- The user may copy a picture unlimtless
- digitally: saving the pictures on harddrives, CDs, USB-Stick, ...
- analog: create prints of the pictures in every size, unlimited number
- editing the photos (exeption see point 3)
- using and publishing the photos (also commercially)
- the owners waive the privilege to be mentioned as owners upon publishing of a picture
3. The owners carefully selected photos to be part of this collection that can be used commercially without violating the right of somebody else. This means that editing a photo in a way that a person that was a minor additon to that photo becomes a main element of the photo is not allowed. In this case you would have to ask this person to agree with publishing this edited picture, if this person does not agree with publishing this edited picture you are not allowed to publish it.
4. The right of use these photos for missionary purposes accoring to the Bible means: The use of these photos serves the kingdom of God and to spread God's word as it is found in the Bible. The photos might be used for this purpose e.g. by members of the World Evangelical Alliance (WEA), Deutsche Evangelische Allianz e.V., and Vereinigung Evangelischer Freikirchen e.V. . Members of organisations like e.g. Jehovah's Witnesses whos religious belief does not correspond to the Statement of Faith of the World Evangelical Alliance are not allowed to use any of the photos. Single persons are also granted the right of use as long as they are not associated with an organisation that does not correspond to the Statement of Faith of the World Evangelical Alliance and as long as they use the photos for missionary purposes according to the Bible (see above).The use of the photos to encourage the world wide church of believers is explicity allowed and it is also explicitly allowed to use the photos commercially for e.g. postcards and calendars that help to spread God's word and to encourage his church.
